Zombie Pandemic - Terms and Conditions
The terms and conditions apply for all users of the game Zombie Pandemic. The
terms are a legally binding agreement that governs your use of Zombie Pandemic.
By using or accessing the Service you agree to be bound by these terms.
Conditions of participation.
To participate in the game “Zombie Pandemic” the user has to accept the
Terms and Conditions stated by the developer of Zombie Pandemic Pixel Pandemic
referred to as the carrier in the following. By sending a request to open a
gaming account ("Account") for the game ("Registration") and with each login to
the games platform, the User accepts the relevant version of the terms. The
carrier reserves the right to modify or extend these terms and conditions at any
time. If modification occurs users will informed in a suitable way by
notification. This notification shall either be effected by a special window
opening on the zombie pandemic website when logging onto the gaming platform or
on the official weblog.
Beta Stage
The game is currently in a beta stage meaning the game isn't fully
developed and thus fully functional. There are still several key game features
which haven't been made available yet. As a result frequent server updates with
adjusted, extended and modified game content can be expected resulting in
instability of the game and thus inconvenience to the user. Created user
accounts may also be subject to deletion at which point a beta tester must
create a new account. User accounts will be reset several times during the beta
test in order to balance out the gameplay.
The game might also offer end game features meaning the game will have a conclusion and thus end to restart depending on specified game winning conditions.
Premium Membership:
Users can purchase a premium membership an enhanced range of functions
and features of the game not available to basic non premium users. Information
on the type and extent of such additional functions can be found on the premium
section of the website. As the game world is continuously being enhanced the
carrier reserves the right to offer new features at any given time and also
reserves the right to modify individual features and to cease offering them. The
user assures that all information provided in the context of a payment
transaction (including bank, credit card number, etc.) is complete and correct.
The payment options vary according to the participant’s country and the market
availability of technically feasible payment options. The carrier reserves the
right to amend its payment options at any time. The carrier reserves the right
to change the fees of the in-game features (including virtual currencies) this
includes the carrier’s right to increase or decrease fees for all singular
in-game features for all future transactions.
Virtual Goods
In addition to premium options users are offered to purchase individual service
offerings and individual features and virtual goods such as items within the
online game. The user is informed separately on the kind of features for
purchase, the purchase price and the available payment method in connection with
the game on the website.
Cease of Operation
The carrier reserves the right to cease operating the games Zombie Pandemic
without justification. The user may demand reimbursement for fees already paid
out for features. This option shall only apply to fees unused up to this point
in time. Any other claims by the user shall be prohibited.
Terms of use
The carrier offers online games and services within the framework of its
technical and operation capabilities with an average annual availability of at
least 95%. Periods of time during which the use of online games and other
service offerings are interrupted or affected due to required maintenance work
the carrier provides no compensation in accordance with the provisions of this
agreement. Periods of time during which server breakdowns occur due to
compelling technical reasons does result in compensation from the carrier.
Submitting suggestions
Suggestions from users regarding game improvements are welcomed by the
carrier during and after the beta testing process. By submitting ideas,
suggestions, in game features, changes in the text contents etc. using the
official beta feedback form or by e-mail the user allow Pixel Pandemic to
actually use this input and all the rights in any given form for Zombie
Pandemic. By submitting pictures, art or similar creative material the user also
verify that no copyrights are violated and are liable in case of 3rd part
validation.
Liability
The carrier is not liable in any way for server breakdown, faulty
programming or any other issues which may cause the service to be unavailable.
The carrier is not liable for any damages caused by the use of game in any way.
Termination of account
The membership may be terminated by the user by deleting the account. You can delete your account e-mailing support@pixelpandemic.net.
The carrier always reserves the right to delete or to block accounts in a case
of violation of terms and conditions, rules of the game or for any other reason
at all. The Zombie Pandemic admin staff decides solely if the terms and
conditions have been violated and the user has no legal claim with regards to
account termination.
Contents and communication.
The carrier offers a platform that allows users to play and communicate
with each other. Users are responsible for the contents of their communication.
Communication also include material uploaded to the website such as pictures.
The carrier does not allow pornographic, offensive and illegal content and is
not responsible for the communication of other users. Offensive communication
includes insulting and threatening behavior. Violations may result in deletion
of user account. All communication and in game tagging is logged in a database
with the users ID.
Copyrights
Pixel Pandemic websites including all data, images, text graphics, music,
sounds, sound sequences, videos, software programs and codes and other
information, that are protected by copyright or by other means in favor of Pixel
Pandemic or for the benefit of third parties. Unless explicitly permitted, the
user is not entitled use any of this content for any kind of purpose. Permitted
is only the technical reproduction for the purpose of browsing as well as the
permanent reproduction solely for private use. Copyright information and brand
names may not be changed and not suppressed or eliminated.
Age restrictions
The game has not yet been rated but is intended for a mature audience.
The game may contain imagery, a storyline, violent gameplay and other elements
which some players find disturbing and not suitable to children. Thus players
must be 18 years or older at the time of sign up.
Accounts
Users are allowed to have one user accounts per server. If the Carrier suspects any illegal actions we
reserve the right to delete the user account without prior notice.
Having multiple characters working together as a premium feature using the same user account however is allowed.
Users are responsible for keeping their password secure and will be liable for violations to terms and conditions due to 3rd part using their account.
Users can delete their accounts at anytime from the settings menu.
E-mail privacy
By playing the game you may be granting your social network permission
to share your e-mail address ad any other personally identifiable information
with the carrier respects the users e-mail privacy and will not share, rent or
sell your e-mail address to anyone. Newsletters are distributed on a monthly
basis or less and users can always unsubscribe anytime they want.
